    New here and need info

    Hi all, Please excuse any typos as I'm visually impaired.

    I will start with a brief discrption of whats going on. A few years ago I was diginosed with a eye desese that unfixable. Before that me and my wife both had stable jobs. I had to get on diability. That resulted in an decrease in our income. We made the necesary changes to survive (repo car,default on a couple of CC). We fix a couple of things (paid off a small CC that a credit agency had and made an agreement with another to pay out). Thing went ok for a couple of years.

    Present> Last year 2010 was a very hard year for us. My wife had knee problems that resulted in surgurys and medical bills. I had a eye surgury and more medical bills. We held our head above water until Decenber when we were informed that most likley more sugury may be needed. Also a good chance my wife may loose her job.

    So we made the decicion to start cutting even further. We moved out of our house ( thinking wells fargo would do a deed in lieu ) thats still going on but is in forclosure. My wife did loose her job the first week in January 2011. Luckaly she was able to reapply and now makes s $10 hr at 35 hrs aweek from $14 hr plus bonuses.

    So this is what I need help with. I have not yet got behind on the CC bills or the money to the credit agency. But most likley will happen as things just keep pileing up. Theres just not enough money to pay bills,pay CC bills,pay doctors,pay for medicine food water and so on.

    I have read what I can about bankrupsy chapter 7. I read there s a means test,we make way less than than the $50000 for a family of 3. Would chapter 7 work for me.

    I read about assets. I don't think I have much,but what can they sell.

    Hi Blueman. The best thing you can do right now is consult with an attorney to discuss your options. Generally, initial consults are free even if you decide no to file. I consulted seven attorneys before I chose mine today. Read all you can here, this is a great place and some wonderful people with good advice and support. I don't post often but have found this site to be a lifesaver.

      I'm not from your state. Try to google your state's exemption. I don't know how current this is: http://www.legalconsumer.com/bankrup...-law.php?ST=TX

      Try to do some research on what numbers to watch out for before meeting with the attys. You will ask better questions for your specific case and get a better sense of how the good ones are.

        Hi Blueman,

        Since your under the median and you have medical issues, I would be very surprised if you didn't qualify for a chapter 7. Before you meet with an attorney, try to get an idea of what your monthly income versus expenses are and they will be able to give you a clearer picture.

        Sorry about your health problems, hope things get better for you and your wife.

          it sounds like you might very well qualify for Chapter 7, but everyone has mentioned, you will want to meet with an attorney (most do an initial consult for free), but come up with your income and expense figures to determine if you will pass the means test (have an idea on those figures as they can better guide you on your options).

          Texas is extremely generous with their exemptions so if you really have no assets, you should qualify pretty easily and will likely be able to keep the items you currently own (for our family of 2, the magic median income # was 54,288 so I imagine it would be more than that for three so it sounds like you will more than pass the means test).

          You should be able to find lots of info about our state laws, but also check your local courts for specific add’l information/forms they may need from you (your attorney should know if you choose to hire one). You should obtain a copy of the latest NOLO book and use this forum as resources, even if you hire an attorney since you're ultimately responsible for the facts and figures you give your attorney. People on this forum are extremely helpful and supportive and will tell you like it is only with your best interest in mind.
