    Hearing on April 11 - Few Last Questions

    Okay I have submitted my petition and am refiling my documents as requested by the court.

    1) Will I need to write Amended on the form if it was never filed?

    2) Does the signature date need to be today's date or the date it was originally filed?

    Also, any advice on how the proceeding will go would be helpful. Thank you!

    hi william,
    1) you shouldn't have to write "amended" on anything new that you're submitting esp since the courts sent you a request for the forms. the courts will log it so be sure to check PACER to ensure that they rec'd the forms.
    2) when we added forms, we dated it the date we submitted it and not the date of the petition. be sure that at least your case number is on anything that you submit.

    Read some of the stickies on this forum, but here's something i posted when we went through our 341...added a couple of things too--

    Before 341:
    Get any items your trustee needs to him/her asap. We emailed the requested items and followed up with a phone call to confirm receipt a week after emailing. The more "on top" of it and prepared you are/you appear, the better.

    341:
    · Be prepared (but yea…no need to memorize things…just try to know your figures well enough so you will appear more confident and prepared). Have all paperwork, IDs, etc in order. Eat breakfast or drink water (I couldn't eat) and breathe. if you have a lawyer, be more prepared that he/she is. you ultimately will be the one answering the trustee.
    .we took a copy of our petition (but didn't need it) along with extra copies of what our trustee had asked for in advance (sent to his office within a week of his request).
    · Get there early. Got there an hour early…it went by quickly and gives you time to settle in and observe. Don't rush or run late.
    · Straightforward yes-no answers as emphasized in this forum. the shorter your answers and the more preppedyou are, the better for you and the faster you're out of there.
    · Business casual.
    · Spit out your gum unless you can control the chewing.
    · Smile and be polite.

      Don't forget your post-filing financial management class. Your court may have a cover sheet they want + the certificate.
