    How long till discharge???

    Ok, filed Nov 8th 2010, had 341 meeting on 12/28/2010, Pacer updated on 2/21/2011 to show Report of no Distribution (after deciding that they are not taking our tax return). On Pacer it shows awiating Discharge for 72 days and awaiting closing 19 days. How long before we get our discharge (thought it was 60 days from 341) and then how long till it is closed? Also, for the inheritance rule....is it 180 days from file date or 180 days from 341 meeting?

    Ugh...I want this over!!

    Your discharge comes, administratively, after the 60 days from the 341 Meeting. The closing might happen immediately or take several more days after that. Closing is administrative and you shouldn't "really" worry about either the closing or receiving the "actual" discharge. The 60 days is what's important! That's the bar date to file a complaint and if no one does, then the only way to void a discharge, is if actual fraud was found.

    It's 180 days from the time of filing to the time you become entitled to receive it. That means, if someone dies within 180 days from filing and you become entitled to -- but not necessarily "paid" -- death benefits or an inheritance, then you must report it! Also, this counts for divorces too, where you become entitled to property.

      Job makes an excellent point...as pay outs from probate courts can many times even take years....

      i worked on one estate it took the probate courts 3 years for any distribution...and i guess that would quite a while for the bk courts to wait....depending on the amount....
