    Waiting game continues....

    Well my filing has been put on hold for another few weeks The past 2 weeks have been unpleasant for me. I had a very sick child that required me to miss a whole week of unpaid work and the hubs car broke down. So some of my attorney money went to fixing his car and paying bills that my paycheck was lacking.

    So we won't have the rest of the attorney money until April 4th. So looks like I'll be filing that week.

    Also I got a letter from the judgment creditor yesterday offering a settlement. It said I had 10 days to call them if not they will start the garnishment/levy process. So I called the original creditor explained to them my situation and that I was very close to filing and I would hate for them to spend anymore money (b/c in FL the attorney has to pay to put in a writ of garnishment/levy per item). She was extremely understandable and was glad I called. She took my attorney's info and said she would call the judgment attorney. Well I called the judgment attorney and yes there was a note from the creditor about the BK and my attorney info is on file. So I'm not sure what is going to happen from there but I don't think they are going to try and collect within the month. (((Fingers crossed))) I did not fill out my financial info sheet the judge gave me so they don't have any bank info yet just employement.

    So that's in update on me

    Sorry things are so rough, I hope your child is feeling better.

    The good news is that your week of missed pay may help you on your means test...I know it doesn't seem like much of a consolation prize but I remember you were worried.

    Hang in there...remember...a few weeks or months of waiting won't make much of a difference in the grand scheme of things. Ours was delayed several times as well but in the end it worked all worked out for us. It feels like forever, but the truth is that this will all be over before you know it.

      First, I wish your child as speedy recovery.

      Second, so sorry to hear about your delay in filing, but as SG pointed out, there is a silver lining. And April 4th will be here before you know it. Our filing was delayed by car troubles as well - my hubby's serpentine belt broke on the highway on his way to the attorney's office!

      Good luck - the next few weeks will go by quickly.....and until then, we are all here for you!

        Sorry to hear about the delay. I can't tell you how many times we had to postpone our filing because of various unseen circumstances. Illnesses, dh's work being slow (therefore smaller paycheck), lightning hit our house last summer, car troubles....always something.

        You're so close, it'll happen.

          Hope your kiddo is on the mend - hate when they get sick Also sorry to hear about hubby's car, hopefully things will turn around shortly for you.

          But - this brings up an area you need to look at in earnest - your budget - and I'll assume you arent paying debts while preparing to file. Since you state you do not get paid for time off work and you had to tap into the money being used to pay for the attorney, have you budgeted for car maintenance, time off work, etc accordingly? You have to have every expense accounted for, so if you know you miss X amount of days a year due to illness (yourself or family) then you need to budget for that, as well as for maintenance of auto's/house/etc. I know budgeting for time off work is hard to do - and can vary greatly, but you should budget for 2-3 weeks of time missed w/out pay, that way once your CH. 7 is completed, you wont have to rob from XX to pay XX.

          Just a thought

              Thanks - Yes I have budgeted for expenses like car and house stuff but haven't actually started saving for that b/c I thought when I file I can't have a savings? right? I used my attorney money to pay for the repairs. So in May I won't have attorney money so there will be money to be saved.

                Hi Freddy,

                been there, done that, on the sick kiddo and sick car at the same time....it is not fun, not at all....

                ...but it does get better! Later you look back and "whew, we survived, not sure how but we did it"

                And it gives you something to share when other parents are swapping "It was so bad that..." stories

                  More bad news..My hubs just called and said his car broke down again...LOL Oh I guess it's pouring in my neck of the woods this month.

                  Thinking outloud (below):

                  Since I am over the state exemption for this car (we are allowed 1k and KBB has it listed for 2K) My attorney said we will mostlikely have to pay the trustee the difference. I'm thinking of having the car appraised at Carmax since it's in such bad shape now... Would this fly with the trustee or do they only go by KBB?

                  And since gas was $3.60 when I filled up today $54 total!! Is it safe to say I can up my gas expense??

                      Wow - I'm glad to hear you child is feeling better! I know that when kids are sick........

                      Boy, I'm right there with you though - may not be able to file for like 2 months and staring a "trial" from our friendly predatory unsecured lender (with whom I actually missed only two payments!!!) in the face w/in 2 months...up against the clock!!! Won't see atty again until like 3 weeks before the HEARING where they set the date for the trial - he seems not to "worried" - of course I did literally NOTHING at work last week....I'm a basketcase guys.

                          TOtally off topic - but - are you really in Nanavut? If you are, how did you manage to get up there?? I wouldn't mind Canada... at all...
                          (Also totally off topic, I'm trying to transition into teaching...I have experience, but it's me and a whole "bucket" of other people...one thing with a teaching job - no fear of garnishments, etc., OR credit reports to get a job because they don't care...)

                              Well another $600 bucks down the drain Good news is we had the Hubs car appraised at Carmax (before repairs) and it came in at $1200.
