So I know I have posted quite a bit lately about my reaffirmation car loan with USAA. Some good stuff, some bad stuff, but primarily just worried stuff.
When my reaffirmation paperwork came through, I went to my attorney's office and sat down to go over stuff. When it comes to matters like this, I am beyond confused (as my posts showed!), and I freaked out even more when I saw the paperwork checked off the option saying there is a presumption of undue hardship.
Some of the responses here said not to worry, even if denied I'd 'most likely' keep the car as long as I continued to pay. Others said it's best to get it denied. I again want to thank everyone for all the responses. My attorney said (and I'm paraphrasing all of this) that it WILL be denied, and they can then immediately file some other fancy paperwork, and then it would 'most likely' be approved, but that he, again, could not promise anything.
So, here I am on PACER and on 3-1-11, sure enough, I was conditionally denied, an don 3-2-11 my attorney filed some follow up paperwork. Nothing since.
I checked today, 3-9-11, and it states
"Order Granting Reaffirmation Agreement with USAA (related document(s) 10 ). Signed on 3/9/2011 (Osment, Kim) (Entered: 03/09/2011)"
It's not much, but I am SO excited. I know there are differing thoughts on reaffirming or not, and I respect everyone's thoughts on it, but it is something I wanted done due to having only 12 payments left, and the fact I wanted no chance at ALL that the car was going to vanish on me. While I fully understand the odds would have been overwhelmingly against that happening (my attorney agreed with everyone here in that regard), I still wanted the agreement, and it appears that I have it.
Oddly, exactly two weeks before my 341 which will be two Wednesdays from now. Nerves are still off the charts, but some happiness today!
Again, thanks to everyone!
