    Should I file an amendment?

    I filed for Chapter 7 in California in November 2010 (no asset case), had a 341 meeting in January 2011 and my case is set to discharge in about 7 days. At the 341 meeting I was asked if I was expecting a tax refund, I said no because I didn't think I would be getting one. Long story shot, I just today found out today that I am getting a refund but after discussing it with my trustee, she said it was small enough that she didn't want it. My question is.....is there any reason I should file an amendment to my Schedule C Property Claimed as Exempt which has sufficient exemptions to cover it? And if I did would it totally mess up the date it is set to discharge on?

    Hi ojaizoo,

    You talked to the trustee about it and she said it was too small to bother with....amending your case comes under the category "more trouble than it is worth"

    The trustee is the person who would care about it, and if she said it ain't worth bothering with, I'd take her at her word.

    Besides which, your trustee knows how much of a pain-in-the-[posterior] it would be to amend.

    My 2 cents is take the money and run...
