    Threatening email

    Most of you know my story...nasty X and nasty X attorney.
    So...even though our divorce was over 7 years ago, my X now claims that ANY debt he can even think of must be divorce debt and therefore non-dischargeable in a 7. I claim to differ because a lot of the debt he claims came long long after both divorce and property settlement. He filed a Motion for NOn discharge which required an Answer. So I filed an Answer.

    But X's attonrey is upset that I filed an answer. He just sent an email threatening that I have no excuse, being pro se, to claim that some or all of the debt is dischargeable based on affirmative defenses of unclean hands, fraud, estoppel...well the list goes on.
    Basically, X insisted that my home be sold to his X-girlfriend for less than my offer to buyout his minority share. He alleges he only got $59,000 from the sale and that he had a $130,000 'judgment lien' which wasn't satified in full...plus he has more claims against me that he hasn't brought up yet (!) . Of course that makes it hard to understand why he didn't just accept my offer to buyout his share for $246,000, doesn't it?

    Anyway...the threat is that since the CODE says that divorce debt isn't dischargeable that I had no excuse to file an answer and that I must just accept that it is dischargeable because...well, he says so. And if I don't that he will PUNISH me and have me SANCTIONED. (I'm trembling in my boots)

    He even helped me out by writing my WITHDRAWAL of my answer, denials, and affirmativ ve defenses for me...isn't that nice?

    I CAN backup my affirmative defenses...and of course since he insisted that the house be sold instead of letting me buy out his share for cold hard cash for much more than he claims he got or even actually got from this sale...it seems that he would have a hard time...in a fair court.....proving that he has a right to complain about anything.
