    This is another fine mess I've gotten myself into .... sigh

    Not sure the best way forward on this. Had listed my two rental properties with a realtor for short sale (to avoid having to file BK). After doing much research decided this was not best route for us. Recently told realtor wanted to cancel listing on one, she was okay with that. The other has an agreed upon contract, at a 40k loss. It is supposed to close at end of April. Nothing has been done to move this forward. I did the SS app online (CitiMortgage), faxed pay stubs. That's it. Am worried about cooperating with bank, supplying all the financial info they want, don't want to give them ammunition I don't realize I have.

    I want to cancel the contract, but know that is going to open me up for a lawsuit. I know, I am filing Bk, but I was told they could wait to bring suit for up to 15 years. Can I just list them as potential creditors, or do I have to wait for them to bring suit? I can't wait very long, and she knows we are planning on filing bk. It seems I could just wait out this contract, surely I can't be the one person in America to get a 40k loss short sale thru on the first go round. Once the closing date has come and gone, I could then refuse to renegotiate, and be off the hook, right? Then cancel the listing agreement? Or by not supplying the info to bank in a timely manner am I, I don't know, obstructing the sale?

    I told her I wanted to cancel the short sale. Says she needs to talk to her broker about what they are going to do (like bring suit for breach of contract). Understands my situation, says they are their to look out for my best interest. THEN she says "what if I could get a cash buyer to pay your payoff and our commission?" What? What? How can she possibly be wanting to sue me on one hand if I cancel contract for SS, then say it will be okay if I let her sell to a cash buyer for full price. Actually way over full price, cause she listed it about 13k under what we owe to begin with. What is going on? I am so confused! It sounded like she had a buyer waiting in the wings willing to pay $40k more than the house is worth. Any one else have a clue what is going on?

    I guess I need to speak to a real estate attorney, probably in another town (this is a large local family agency with real estate attorneys in the family).

    ...was told they could wait to bring suit for up to 15 years. ...you was told wrong! Once the BK is filed, they are [feces] out of luck. The 15 yrs is probably the statute of limitations in state law.

    Can I just list them as potential creditors, or do I have to wait for them to bring suit? ...list them, list all potential creditors, past creditors, list the kitchen sink, ..well you get the idea

    What is going on? I am so confused! It sounded like she had a buyer waiting in the wings willing to pay $40k more than the house is worth. Any one else have a clue what is going on? ....I think your realtor is dreaming about that commission...tell them to fax over an offer, see if it is a real deal or a pipedream

      Thanks again Tom, maybe I can sleep tonight! My biggest problem is I didn't know how to include the debt if I don't have a specific amount (ie, they haven't sued yet). I guess I would just list the Realty Company, my realtor, buyer's realtor, and buyer's names? I know my bk atty will tell me all this stuff, I just need to be sure I get all the info I need while the realtor is still talking to me. Would this all count as "non-consumer" debt, since it is on the rental property? If so, yippee, my percentage just went up even more!

      Tom, I want to thank you so much! You always have a great answer, and I always feel better when I see the responses from you. You never make me feel bad about my stupid choices, lol. I wish the best to you and your family!

        i'm with tom on this one.....

        go tell them ALL to take a hike and do what is BEST for you and yours.......file the bk...list them....

        people or deals fall through all the time...who the heck can afford a civil atty to sue someone that's going BK!!!!!!! and don't forget most likely they have to pay that civil atty a few grand if not more to sue you... not worth anyone's time or effort.

          I would list the (potential) debt as undeterminable. That way it is listed and the amount can be whatever or list it at the expected commission plus some added amount for insult.

            good point...we used that phase ...as well as "unknown" in the amount colum a lot!! LOL!!!!!!

              Tobee and Daylate thanks for the info. That was kinda my problem, I didn't know how to list it in the bk if I didn't know how much I owed, or if I could list it if they hadn't taken action yet. I was afraid since the realtor knew I was going to declare bk, they could wait me out, then file suit against me after my bk was over, and there was nothing I could do about it. Boy, this is such a relief!

                no problem...glad to help...most people don't do this everyday..

                ask questions..it's the only way to learn and this site has some great people that are more than pleased to help when they can..
