    Statement Regarding Secured Consumer Debts - should I sign this now?

    I filed earlier this month and my 341 is scheduled for next month. I just received documentation requests from my trustee. Was wondering about one of the forms that states in his letter must be filled out before my case can close.

    The trustee wants me to sign and send back a form a called "Statement Regarding Secured Consumer Debts" and other documentation he has requested. I included statements of intentions for my house in the bk (not reaffirming - but am current and am planning on staying and paying for now...) and my car (reaffirm - I still have to get my reaffirmation papers done for my vehichle.)

    Should I sign this form at this time and send back to the Trustee with the other document requests? If I do sign it, I feel it isn't true, since I havent done any of the following as shown on the statement.... here is basically what the form says

    Statement Regarding Secured Consumer Debts

    i (we) certifiy under penalty of perjury with regard to all secured consumer debts.

    As to each debt I (we) have done the following:

    1 Surrendered (house)
    2. Reaffirmed (car)
    3 Redeemed.

    Debtor Signature

    *****************

    I have an email into my attorney about this, but thought I would ask all you about this as well, and see if any of you have already done this, etc...

    Hi maffy,

    This should be the same as your Statement of Intentions filed w/ your petition. Sounds like your trustee wants it directly w/o having to dig it out of your petition packet. Our trustee did the same thing, fill out his forms but it was info straight from the petition paperwork. To each their own I guess...

    This won't be the first time your attorney has seen this, they will tell you what to do. Likewise the other documents, your attorney should know how your trustee operates.

      Thanks Tom! My attorney straightened me out on this one and yes, it has to line up with what I filed with my Stmt of Intentions... your explanation of the Trustee not wanting to dig it out of the petition sounds spot on. No biggy, I'll just fill these out as many times as he needs it. I am going to take a boatload of documentation to the 341 meeting with me just in case (I'm self employed and not much has been asked for in advance) and I just hope everything stays uneventful from here forward!!! Thanks for your reply!
