    DISCHARGED!!!!!!!!! But some questions....

    Discharged on Feb 7th! I'm so freaking happy to be almost to the end of this nightmare. Thanks to everyone here for all your help and understanding. But.....

    If some of you remember, I went in as a no asset case. Giving up car and home. I was first given "report of no distribution" and was on my way. THEN, mortgage company asked for relief of the stay, trustee denied due to the Deed for the mortgage wasn't valid and was void. Then my trustee removed the "report of no distribution". Then my mortgage company pulled the request for the relief of stay....Thats how it stood for a bit, but then I saw "Discharged". But not closed yet. So, even though discharged, is the trustee still doing stuff behind the scenes with this mortgage mess? I'm still planning on getting out of the house when its time. Just haven't heard anything from the trustee, or my mortgage company.

      A discharge does not close the case. It ends your issues with your creditors. Your Trustee is still administering the case and, if there is no properly perfected lien on the real property, eventually he will sell it for the benefit of the creditors (or settle with the mortgage company in some fashion). This could take months and months and months - no way to tell. But, your life goes on.

        ahhhhhhhhh the mortgage mess....

        the trustee could still be doing something with them...and that's why you have not rec'd the order of no distribution.......however, really...if you surrendered the house..i'm not thinking even a trustee can make you take it back....any one know better PLEASE clime in....at least i have never heard so...

        also...although we rec'd our discharge and order of no distribution the same day...it doesn't always go that way..i have heard some wait even a month in between the notices...so i'm hopin it's all good..

                The trustee apparently views the mortgage issue as an avenue to obtain at lease some payback for non-mortgage unsecured creditors. If the mortgage is not properly perfected, that loan simply becomes another unsecured claim.

                It doesn't really affect you if you were surrendering the house anyway - it seems that it would only affect the payout creditors would receive. You still have your discharge.
