I missed my hearing for my 2004 Examination that one of my creditors filed. Will they dismiss my bankruptcy or just the creditor?

Please give some details. My crystal ball is not working right now. However, based on the fact that my husband and I had to undergo a 2004(b) Examination, and we HAD to be there--no excuses--not even death, you are running the risk of having your BK dismissed.
Pray tell, WHY did you miss it?Last edited by AngelinaCat; 02-20-2011, 09:15 PM."To go bravely forward is to invite a miracle."

I don't think this looks very good on your part, so I'm on team probably-gonna-dismiss-your-bk.

I am sorry, but I/we need more information.
When we were notified of our impending 2004(b) Examination, we had at least 30 days, if not longer. I am not where I can get at my paperwork now, but I can do so tomorrow, and let you know.
Our situation concerned the disbursement of a mortgage payout. We had to locate any and all receipts accounting for this money within a certain time-frame.
Now, what is yours?
ETA: Since I said that our Examination was a 2004(b), what form of of Examination 2004 is yours? Knowing the answer to that will help a great deal.

Thanks for responding Angelina, I already had my 341 and they didn't show but the creditor filed a motion to extend time to file objection and for me to give a 2004 Exam by the creditor. When it was filed I had less than 2 weeks, but by the time my mail was forwarded and I received it, I only had 5 days.

If we had a 2004(b) Examination, that means there exists an (a) or (c) clause to this 2004 Examination. I need you to read your paperwork and tell me what alphabet letter this is, so I can get a better understanding of it, so maybe I can help."To go bravely forward is to invite a miracle."
