    Non Filing Spouse and Mortgage - Affect on His Credit?

    I filed for chap 7, received notice of intent to abandon property due to lack of equity in my house. My husband did not file. The only joint debt we have is the mortgage, which is paid on time. Will his credit be negatively affected? I asked our attorney, he says his credit report will show the mortgage 'in bankruptcy'. But, we pay on time. His job is dependent on good credit. Anyone have any info on this? Thanks.

    It's an grey area...however, for joint debts, if only one joint debtor files BK, the BK should NOT be placed on the non-filing debtor's credit report. Reason being, the debtor did not file BK and therefore it would be inaccurate.

      It shouldn't show up on his credit but check it to make sure. If it's there, dispute it.

        Thanks for the responses. Also, I made a mistake, it was the bank not my attorney who said the mortgage would show as 'in bankruptcy' even on my husband's cr rep. I will definately check his report to make sure and dispute it if necessary.
