    Filing Help

    Hi guys so to bother you guys, I just have a quick question,

    If you are single but living with a gf and another individual related to your gf
    and wants to file bk,
    do you count them as people living with you
    or do u have to just put 1 instead of 3.

    Coz i was thinking that no matter if u are not married but is living with someone they count as well.

    If you are living with a girlfriend and there is a third person living in the household, you have to count the entire household income, because presumably the three of you are contributing to functionality of this household. As to whose property is whose, that is where you start to divvy up when you fill out your schedules.

    Go to nolopress.com and purchase their online guide for filing Chapter7 yourself. You can get it in an easily readable format, and it will help you with many of these types of questions.

    SUGGESTION: Please start writing in complete words and sentences. This blackberry shortcut nonsense is tiresome to read/translate, and if you attempt it in the 'real work world', you may find your employ-ability limited. This is just a friendly suggestion.

      Hi philsylan,

      One factor is how much does everyone contribute to the household expenses. What your two roommates contribute to household expenses is considered income in your BK case. But not their whole income, just what they spend on the "household" expenses; utilities, food, etc.

      What they spend + your whole income = income used in BK ....household size = 3 ...household expenses = total of what everybody spends on household expenses

      ..alternate scenario: use your income only; household = 1; household expenses = total expenses divided by 3

      BUT.....this is a gray area in BK law, very gray, foggy almost....a good local BK attorney can help you figure out what trustees in your district are like.

        I had to included my son's money that he paid towards the rent, His money went into my account each week so i could not add in less money. I still was under the allowed amount for my state
