When do I submit Divorce Decree?

Do I submit my divorce decree with the original filing, or wait for the trustee to request it? And I'm assuming a copy OK. Or do they normally want an original sent to them?

Why do you think the Trustee wants a copy of your Divorce Decree? The only reason they would want to see it is if you were exempting assets due to the decree that normally would not be exempt. My attitude is don't offer any documents until requested.

Thanks! I just assumed they'd want to see it since the ex is a co-debtor on a few items.

I gave my attorney a copy of my divorce decree because they wanted it. They needed to read one part of it (the one that said my ex wasn't responsible for any of the debt that I was discharging and that the financial division was considered a support obligation) and that was it. They didn't submit it to the Trustee.

Your attorney may want to see it, especially if you were court ordered to pay the debt. You may not be able to discharge it depending on the wording of your Divorce Decree.

A copy would be OK, give a copy to your attorney but not to the trustee unless they asked.

With trustees the procedure is "not asked, don't tell"

Actually, the agreement says she is responsible for most of it. But, she stopped paying and is filing CH 13. The creditors don't care about the divorce agreement, only that I'm a listed debtor.

My car is worth less that bluebook, because it needs repairs. I was planning to submit a dealer estimate for repairs or an appraisal to justify the true value. Same rules apply here? I'll get the estimate, but just hold onto it until asked?

That was 'Hub and I. We were told by the trustee's office to bring a copy with us to our 341. Our attorney had not heard of this before. So we did, and when we tried to give the copy to the trustee, he said he didn't need it.

Well, it WAS needed, because the lack of it in our file held up our Discharge.

We never did find out why it was needed. We suppose it is because we use different surnames, and were married in South Carolina, and it had not been recorded in Florida.
