HOA fees and Water/Sewer fees

Hello everyone,

I am filing for Chapter 7 BK by myself, and want to know on what schedule do I list my HOA fees. The Condo Association is attempting to force a foreclosure and I am surrendering my property.

Also I am behind on my Water/Sewer fees, is this dischargable?

Hi schroed9r, and welcome!

Water/sewer is dischargable. Goes on Schedule F
Unless the HOA actually goes through the process to attach a lien to the condo, and I seriously doubt they will, they go on Schedule F

ps: a couple days after you file, the HOA will get a copy of the BK notice in the mail. Then they cannot try to collect the debt in any way. If they contact you, document everything they say, every document they send. If they are true to form, they will still try to collect from you, which is illegal and they can be sued in BK court...where judges are notoriously favorable toward debtors!
