Hi! The means test determines whether there is a presumption of abuse that would prevent you from qualifying for a Chap 7. It is described in detail at http://www.nolo.com/legal-encycloped...ity-29907.html And there is a link to the "means test calculator". Keep in mind that an attorney may very well come up with a different result than you do. But, it's a good way to get an idea of whether you qualify. Also, even if you pass the means test, a trustee could object to a Chapter 7 if it appears "based on the totality of circumstances" that you have the ability to fund a Chap 13.LadyInTheRed is in the black!
Filed Chap 13 April 2010. Discharged May 2015.
$143,000 in debt discharged for $36,500, including attorneys fees. Money well spent!

Hi staron,
Use NOLO to understand how the means-test works. I didn't trust the online calculators so I got the actual form and filled it out.
For the real deal, go to http://www.uscourts.gov/FormsAndFees...ptcyForms.aspx and get form B22-A
Go to http://www.justice.gov/ust/eo/bapcpa...anstesting.htm for some of the data to use filling it out
Go to http://www.justice.gov/ust/eo/bapcpa...ne_by_line.pdf for some line-by-line explanations
Good luck on this!
