    Okay, that's good to know about the car. I'm breathing a tad easier. I'm going to contact my attorney just to re-remind him that I will want to reaffirm, so be on the look out for something from USAA.

    As for the insurance, I hope everything goes well with it. If my premium goes up, well, I can handle that (if it's around the same amount you mention), and I would truly hate to have to go elsewhere. But then, if I do, I guess I do.

    Now, in regards to Pacer, I just now logged in, and I cannot for the life of me find my case. I have followed the guide, but it simply cannot find my case number, and I could be missing it, but I can't find the option to look things up by social security number. I did a quary by my name, and nothing came up (minus the $0.08 charge, ha!), so I'm kind of confused about it. Like I said, I do have my case number, and Pacer appears fairly straight forward, but as of now, I'm kind of just lost with it. I'm going to mess with it a little more before I have to head into work, so hopefully something will pop up!

    I appreciate your response and the detail provided. It's hugely appreciated.

      Well, I posted the above response TOO soon. After messing around some more, I found the correct way to look up SSNs, and sure enough, my case popped up. One key item that came up: 341 to be held 3/23/11 at 9:30am! Gives the person's name and everything (know everyone knows that, but it's new to me!), so let's hope this individual is kind. My attorney did state it it would take 3 - 5 minutes and that would be that, so I sincerely hope so. Some of the items are confusing, but the last update was 2/9/11 concerning BNC Certificate of Mailing. Wow, my nerves just shot straight up.

      Another key item: states that the last day to oppose discharge or dischargeability is 5/23/11, so is it THAT date where, barring anything strange happening, I'm 'done,' so to speak? This just got VERY real. Not that it wasn't before, but you know.

        pikaroth, congratulations and it sounds like you're managing everything quite well! We reaffirmed our car loan through USAA; they sent a reaffirmation agreement to our attorney and we just ducked into a little conference room to sign everything after our 341. The only thing odd about it was that they added me onto the loan (whereas it had only been in my husband's name before).

        Our car and renter's insurance through USAA hasn't changed (knock on wood).

        As for the website, I had lost access long ago after I stopped paying my credit card. I had no idea about the mobile website until my husband lost access (which happened maybe a month or two after filing, sounds like they were super-quick with you!). The car loan does not show up there at all, and we don't get bills, so we just have to remember to pay. The mobile site isn't as good as the regular one, but it'll do the job for most things. I don't know why they "punish" us with the crappy website; it just means they have to spend more time and money answering phone calls!

        About the $0.08/page charge on PACER, I think you have to run up $10.00 in a quarter before they even bill you. If you're just checking your own case, you probably won't have to pay anything.

        And the way it works is: after your 341 meeting, your creditors have 60 days to bring objections. So you might not be actually discharged on 5/23, but once that 60 day period is over you get to do a hamster dance!
        Filed non-consumer no asset Chapter 7 on 7-12-10 after 4 foreclosures, 7 lawsuits including 2 deficiencies, 2 wage garnishments, a bank garnishment and a partridge in a pear tree. 341 held on 8-11-10. Discharge 11-4-10.

          Hi Pika, Congrats on your filing! 5/23/2011 would be when you would begin to look for discharge. It could be any day after that. For example, mine took an additional 10 days. Between 3/23 and 5/23 you'll hopefully be hanging out nicely in the 60 day club. You're on your way to your hampster dance! Meanwhile, enjoy nobody bugging you anymore that you don't want to!

            Hi Pikaroth,

            The Florida middle district won't require a hearing on the reaffirmation as long as your attorney signs off on it. If USAA doesn't send the paperwork, have your attorney contact them for it. In the meantime, I really wouldn't stress about it, I'm sure it will all be fine.

            Much like you, I found this forum long before I filed. I cannot even begin to tell you how much I've learned or how helpful this site was for us. We are now discharged, but not closed (tax return!) but the worst is behind. Be prepared, this forum can be highly "addictive" lol. I've posted far more since discharge than prior to filing.

            Best of luck - I am sure everything will go well, but if there's anything I can help you with feel free to pm...we're in the middle district too.

              i'll go with you ...if you want.....i will......i know we have seen each other at the publix on 27....but it might be time to really BE there for you..if you need....really...and sincerely...

              we need to have a FL....BK forum get to gether....after we all get discharged...i'll cook...when i get back on my feet!!

                Wow! Nice to see my thread back again!

                tobee43 - we truly do need to have a gathering once all of this is done for all of us in the area. If anything strange happens, I may take you up on bringing you along, but I know I'll be okay, and my attorney will (better be!) be there with me, so I assume if something comes up that I cannot answer, he can jump in.

                As far as the USAA loan, I did get the reaffirmation agree. Instead of typing it all out again, I'd like to point to this thread I started concerning it. The final post in the thread from me is the most up-to-date information I have on the reaffirmation:



                And for SuneshineGal - thank you very much for the kind words. Deep down, I think everything will go fine. It's so strange because when I first decided to do this (all those months ago (October)), I wasn't that nervous. Once I retained my attorney and was officially advised to cease paying all CC statements, THAT was the first time I got nervous. I again won't go into detail due to having done it enough on here months ago, but I was scared to death. Couldn't sleep for a day or two, always nervous, etc. I did slowly but surely get over it. Now, though, with the 341 hearing a little over two weeks away those nerves are coming back. From the second I walked into the lawyer's office, I was told I had an exceptionally straight forward case in that below the median income, no assets, all CC debt, etc., and to be honest, it HAS gone smoothly. I completed the two courses, have given them the info they want, etc. Still, I just now e-mailed them (due to it being the weekend) because I freaked out that in December my parents' Christmas and birthday gift (my birthday is a week before Christmas) was a check for $400 which, of course, I deposited, and it never even ONCE crossed my mind that a trustee would look at that and... well, who knows? I don't want the trustee to think I have an additional income or what not. I assume my attorney looks over all my statements and would make note of a deposit like that and have said something to be if there was an issue, but again, I just e-mailed him due to it being the weekend to see if it matters or not.

                Heck, even if I were given a few thousand dollars, I'd be below the median income. But it's something small and 'innocent' like that that suddently just had me freaking out.

                    Hi Pikaroth,

                    The $400 gift should not be a problem unless it's sitting in the bank as cash you can't exempt, or, could be considered regular income that pushes you above the median. (ie: say your parents were paying your car payment every month, it would then be "monthly household income"). I wouldn't lose any sleep over it, I doubt it will become an issue.

                      Thanks for the continued responses. I did not THINK that the $400 would matter, and as I said, it NEVER crossed my mind, until my attorney said the trustee was asking for my last three months of bank statements, so when I went to print them and saw that, I just thought, "Oh, no, what if this gets questioned?" However, I did think that that is what I am paying my attorney for, to look over EVERYTHING and ensure I am not blind sided at the 341. As far as something like $400 every month - nope. That was my Christmas/birthday gift. On the other hand, my parents had from time to time assisted me (one of the reasons I am doing BK, it's just not fair to them to ask them for gas money and all that, especially at my age).

                      Still, my attorney has all of my bank statements, and it did just kind of freak me out thinking, "Oh no! Willl the trustee think I have a second job I didn't bring up or something?!" My nerves are again in overdrive with the 341 rapidly approaching.

                      And yes, I DID e-mail my attorney with the same question and I'll either get an e-mail response or a phone call from him tomorrow as I always do. Gotta give him (and on occasion his paralegal) credit on always contacting me nearly immediately upon asking a question, and I just want to breathe easier.

                      I cannot wait until the 23rd is behind me, that's the big day. Trust me, I'll post a message the day before asking for good thoughts to be sent my way.
