    Chapter 7 Discharge; problem with one credit bureau and one creditor

    After acouple of weeks after my debt was discharged by the courts, I went up to pull my credit reports from all 3 credit bureaus. Everyone but one creditor is not reporting the correct information. I had to dispute some mirror stuff as the reporting data as late payments and payment history with one credit bureau. However, this one creditor that is listed by one credit bureau, that was included in the chapter 7 filing is refusing to update the file from active to discharge. I disputed with the credit bureau, but the response from the investigation is that the creditor told the credit bureau to "leave it as it is on the credit report, we don't care if the debt was discharge". The credit bureau stated that since the creditor states that it stay on, it stay on.


    I am trying to figure out what else I can do in fixing this problem with this one creditor and the transunion credit bureau.

    Has any one deal with experian regarding in reporting payment history and account history, after debt was discharged. I notice, they were the only credit bureau that is doing that.

    Is that exactly what it states and do you have that in writing?

      Well, first you need to get the results of the dispute investigation in writing from the credit bureau. Then you need to send a copy of that letter along with a copy of the discharge to both the creditor and the credit bureau. Include a letter asking that your credit report be updated to include the correct information. Send it certified - receipt requested. If after that your record is not corrected, you can file a suit for willful violation of the FCRA/FDCPA.

      That's a topic that is a little outside the scope of this particular site. I'm not sure about board rules her regarding linking to other sites, but if you google the phrase, "sue your creditors and win" (with the quotation marks) - you will find a message board that deals with this type of issue.

      With that said - there are still things creditors can report. Your history with them doesn't disappear with discharge. They have to report the status properly, but any history before you filed can remain.
