    Tax Refunds While Waiting for Discharge

    Had 241 in early January and date of last objection is mid March. Trustee does not want tax refund so I'm ok there as far as filing and getting a refund BUT one of my creditors is the IRS for back owed taxes (2002). Should I wait until after mid March when I'm completely discharged or would I be safe to file my taxes AND get my refund without them garnishing it?

    Hi Lynn,

    If the back taxes were discharged, prudent course would be to wait until the discharge. Even then I can see the IRS not getting it right and you having to put the discharge order under their nose.....

    If the back taxes were not dischargeable it won't matter.
