And I am a nervous wreck.

We are below the median and our attorney seemed to not think anything was a problem but I am freaked we will be pushed into a chapter 13.

When Can I expect the 341 meeting? How long after filing?

You will have the 341 in about a month. My bet is that it wil go very well for you. If there are problems at the meeting just know that there is almost always a way to work things out. Why are you worried about it moving to a 13. do you have significant assets?

Hang in there and take care of yourself and your family, you have taken the first important step and now it is one foot in front of the other. Things are going to get better.

No we don't have any assets.

I am worried about a few things.

1. Our lawyer put the expense for both mortgages on out schedule J but we are surrendering the house. I was worried about putitng those expnses if we are going to surrender, but he says he has done it before and it shouldn't be a problem. I'm worried the trustee will remove those expenses and count it as disposable income.

2. I receive a yearly bonus in march. The bonus is not set and fluctuates but could be good this year, I am worried that the trustee will add that bonus as additional income to push us into a 13. The attorney said it should not be a problem since it wasn't part of my income when we filed.

also just talked to my attorneys office. My 341 is march 28, 2 months after filing. I am guessing it is just a backe dup court log and not becuase there is already a problem.

I guess I should add a 3 since I found out when the 341 is.

I recieve a yearly raise in March so I will recive the raise before the 341, not much but if it adjusts my schedule I it could push me into a 13.

Its stressful, but remember you hired your attorney to have your back in all this, best to stick to the plan.

The time till 341 seems completely reasonable, and a good suggestion for an antidote to the pre-341 jitters is to go watch a few. Your attorney should be able to give you the when and where. Really cuts the anxiety level, highly recommended!
