    Today has been 60 days.. so now what?

    Today is my 60th day...341 was held on 11/23/2010. So now what? Nothing has been posted on the PACER? How do I find out if the trustee will make an objection? THe only things that have come up is he is questioning our vehicle exemption. The truck came back at $6,000 and we are allowed $5,000. However, we still owe $750.00 which I hope just cancels the equity. The second question the trustee had was in regards to our tools of trade exemption. He asked how we could claim the tools of trade when we had listed some tools as a business expense...

    We answered the best we could and have not heard a peep. I have this sick feeling they have audit us to death and the nightmare is just going to begin...

    Do trustees have to post something in the 60 day time window?

    From what I understand, I want to see "No Distribution" or something like that..

    Urgh... I hope this is almost over

    the "report of no distribution " is posted the day after the 341 but it can take 2-3 weeks longer
    60 days after your 341 u get the discharge but it can take longer

      So I do not have report of no distrubution yet.. and it has been way over three weeks. Is this a big concern??

        sometimes the "report of no distribution" and the discharge order show up on pacer at the same time but thats not the norm
        were u a no asset from the beginning?
        do u have an attorney?
        maybe the trustee is very busy
        i wouldn't panic just yet

          Jen, I see no harm in contacting the trustee and phrasing it as wanting to make sure that there is nothing he/she still needs from you to resolve your case. Chances are, he/she probably just hasn't had time to review it yet. Had your 341 ended with no outstanding questions, he/she probably would have filed the distribution report immediately to get it out of the way. But, since follow-up was needed, it is probably "waiting in line" so to speak behind a bunch of other cases he/she needs to review. I had a similar experience with a reaffirmation. My case sat idle for 5 months after my 341 until it was my turn for a judge to take the 60 seconds that were likely required to approve my reaffirmation. Once that happened, my discharge went through the same day and I was finished.
          4/2010 - Filed Chapter 7 no asset case w/car reaffirm
          5/2010 - 341 meeting, no creditors present
          10/2010 - Reaffirm finally approved and case discharged the same day

            Thank you all.. I will try and contact the trustee tomorrow. My attorney told me to wait 30 more days... I really am losing my patience.

              If your attorney told you to wait 30 days, you should probably take his advice.

              $143,000 in debt discharged for $36,500, including attorneys fees. Money well spent!
