    HELP!!!! Is my discharge being held up?

    HELP!!!!

    Discharge should have been Jan8, but Pacer still has "awaiting discharge". No mail has come and I have turned in my financial mgmt certificate. I am making payments to the trustee for the money I owe him, which i have a letter that says I can make it in 5 installments. Will my case not be discharged until this money I owe is paid? (its from earned wages and vacation I had coming at the time i filed)

    Also, if I stated in my docs that I would be turning over my car, is the car still under protection as long as I am not discharged? When do i/did i lose protection?


    ps.......I am in Colorado and notes here said as of November they were backed up 30+ days.
    Filed PRO SE 10/12/10......341 held 11/8/10......awaiting discharge.....

    It is probably administrative delay, I wouldn't worry about it.

    If you haven't received your discharge by Feb 4, call the BK court clerk. Assuming there really isn't anything holding up your discharge, they may expedite it for you.

    None of the things you mentioned would hold up discharge. (they will delay closing, but not discharge).

      Our lawyer said A LOT of discharges are taking up to 90 days now.

        Yup,

        I am now 93 days and still counting(waiting). This is 93 days AFTER the 60 day bar date had pased. Still no movement or activity on my case and no help from the clerk.

        Just hang in there.

          thanks all,i dont mind waiting.......... still just need info on the "stay".

          can they come get my car now or do they wait for the discharge before they can come take it?

              If they haven't filed a motion for relief from stay, then the repo company must wait until discharge.

              If they file a Motion for Relief from Stay, once it is granted by the judge, they can come get it at anytime.
