    Recently discharged from a ch 7 - now on to a ch 13

    This is really a wild ride. I was discharged last month from my chapter 7, now I am going to file a chapter 13 in a couple weeks. How many on the board can say that have done this?

    This is my lawyers strategy to buy me some time since they were planning on auctioning my house in 2 weeks (thanks for the notice you S.O.B. mortgage company).

    I am basically living on so many forums on this board it's not even funny

      There's a possibility we may end up doing this too- our lawyer calls it a "quickie 13"- doing a 7 then turning around and doing a 13 due to mortgage arrears. I'll be curious to hear how this goes for you. I had done some reading on here that said it could be considered bad faith when doing it right after a 7 just b/c of the arrears. We are considering (depending on when we end up needing to file- lawsuit pending for a cc) trying to enter an agreement to make up the arrears with the mortgage co. before we file (hoping to do a 7). They would want anywhere between $2-4k to set up the plan (seems a bit steep to me when our arrears are $8400) and I don't know if we will have that before we need to file. Our lawyer said if we had it in writing and we were paying according to plan it shouldn't affect the 7, or our account w/the mortgage co. He said if they won't work with us, or if all else fails then we will do a "quickie 13".
