We filed Ch. 7 on 11/8/10 - 341 held 12/13/10, Trustee's Report of No Distribution on 12/14/10. Then on 12/15/10 the US Trustee filed a Presumption of Abuse because we failed the Means Test. We knew that would happen too, as husband got laid off in August, 2010. His being unemployed is the reason we ARE able to pass Means Test now, but we filed early because I was about to be garnished.
About 4 days after the UST filed their Presumption, our attorney called and said the UST just needs to know the date he became unemployed. That is all, over and out. Done. We haven't heard a peep from anyone since. The UST's deadline (they have 30 days from the date they file the presumption, right?) is this Friday to file a Motion to Dismiss is Inappropriate, or a Mot. to Dismiss, or a Mot. to Convert, or Withdraw the Presumption. . .or whatever. I have this strange gut feeling that she will file nothing - I don't know why. Anyway - if she files nothing, does that mean she no longer is allowed to file a Dismissal? I still have a month to go in the 60 day club, but of course I want this overwith - just like everyone else. My question is - has anyone dealt with a UST not filing anything after filing a Presumption of Abuse and still getting their discharge? Thanks for all your help!
