    US Trustee requested 6 months of pay stubs 2 days after 341 meeting.....

    Attorney called Friday, 1/7/11, said US Trustee wants pay stubs from 5-1-10 to 10-31-10. He wants them by 1/12/11. I have most of them and faxed them to attorney and will get the remainder on Monday from my husband's employer and then fax those too. Our 341 meeting was Wednesday, 1/5/11. My husband gets paid weekly, so that's a lot of stubs in which some got misplaced, but I should have no problem meeting that deadline for the US trustee. I can understand that he would want them to verify income, but wondering why he would need 6 months worth and not use the year to date section of the latest pay stubs?

    Also, my question is, do you think he may request other information too. I just want to be prepared. I'm hoping he asks for everything he wants at one time and doesn't ask for pieces of documentation here and there and drags this out. Any input is greatly appreciated.

    I had to supply the paystubs before the 341 (trustee requested) but I also brought back up copies with me to my 341. I would say maybe the trustee forgot to ask for them. If he had requested them before and you didn't have them, he would have continued your 341. Sounds fine. I am sure he is so busy that the usual information requested just got overlooked. My opinion is that your all good

      Another question/concern....the trustee at the 341 meeting is a "panel" or "interim" trustee, not the government (US) trustee. The "US" trustee is the one who requested the pay stubs. Am I safe in assuming the trustee at the 341 should have asked for them, didn't, and therefore once the file hit the "US" trustee, he wants them? Also, at the end of the 341 meeting I asked my attorney if the the trustee may still ask me for more documentation and he said probably not "this" trustee, but the US trustee may (which he did 2 days later). The 341 trustee reported "no distribution" on Pacer on Thursday, 1/6/11 and asked for his discharge from the case. I'm wondering if the "US" trustee wants these stubs before taking him off the case? Really, I have no clue how this works, so please enlighten me. And again, as to my other question, do you think the US trustee will ask for further documentation in a "piece meal" fashion rather than just ask for everything at one time. My attorney said the US trustee wants to know how I came up with the figures on the 6-month income sheet and again, this totally makes sense to me, but I'm quite the worrier and won't get much sleep for at least another 60 days!!!! Thanks in advance to all of you to post your replies and I so much appreciate it.

      Also, tyson24, your reply does make me feel better and I'm hoping that is what happened in my situation.

        Did the panel trustee ask for any income records from you at all?

            Sounds like it may have to do with the means test. The six months just before filing date would be the ones that count.

              My attorney wanted my 6 months of paystubs before he even filed my case.

                Hi all, Hi csonly,

                The panel trustees job is to find any assets, liquidate them, and distribute proceeds to creditors.

                The US Trustee acts like an auditor, makes sure everything was done correctly, both you and the panel trustee.

                If I had to guess, you were over-median enough to trip the automatic look-over from the UST office. So the UST wanting 6 month paystubs is logical, those 6 months are used in the means-test. The UST may want information piecemeal or in a huge pile, depends on how they run the office.

                Wouldn't worry at this point, all well within the parameters,
