Tax return for 341 -- full version, or two-pager?

At the 341 (or before?), I know I have to have my tax return for the last two years -- do I need to bring the full 14-16 pages, or just the two-page main part?

I actually contacted the IRS and ordered my return transcripts. They mailed them to me within a week or so. I didn't have transcripts for '07 (we were told to bring '07-'09 returns), so I just submitted the main two pages, but we were just standard deduction - no itemizing. Wouldn't hurt to bring the entire thing, better to have more than not enough ;)

      Hi sillywalks,

The federal BK rules say the "Federal income tax return" (or a transcript) for the year prior to filing has to be in the trustees hands a week before the 341 (plus any creditor who asks). What constitues a "return" doesn't seem to be defined.

Another rule is that your trustee can ask for more documentation, such as last 2 yrs instead of just last year, all the schedules vs just the 1040 form, bank statements, marriage license, dog license, .....OK, maybe not your dog license...

Best bet? Send the whole ball of wax, better safe than sorry. Either that or find out what the trustee wants to see.

And be sure to take everything to the 341, you probably won't need 90% of it, but sure as the ghost of Murphy haunts the earth, if you don't take everything, what you need will be in that 10% you didn't bring !

ps: did you know there was a real Murphy? He was in charge of the high-speed test track at Holloman AFB just over the mountain from where I grew up. What is really ironic is that after Murphys law got popular, he tried to get royalties on it but the judge turned him down, said it was in the public domain..
      Ch7 filed 5/12/2010.....341 meeting 6/30/2010....report of no distribution 8/15/2010.....discharged 10/01/2010.....closed 11/09/2010

The tax return thing is in FRBP 4002(b)(3). It's the return plus any attachments, or a transcript, or a written statement that it doesn't exist.

Thanks free2breath, Tom, and debee! I will probably submit the two page version and bring the long versions with me. I am in the process of creating my notebook to take to court -- stuffed full of documentation and forms and such.

Murphy got robbed! So unfair, so appropriate!

I had to mail the trustee my returns, to arrive at least a week before my 341. I sent the entire 14 pages returns...why not - I had them. And no need for the trustee to wonder why I only sent him 2 pages...and request the rest!

Bleah -- nothing to hide, but it makes me worry that I might have done something wrong and they'll 'get me'. LOL Or, maybe, they'll get TurboTax! LOL

I had to send the previous two years to the Trustee 7 days before 341 and he specifically said all pages.
