I was wondering if anyone knows what happens to escrow overages when you claim BK. I have a credit card with this same credit union which will be included. Can they keep the overage as a set off for the credit card?
I previously received a Tax and Insurance Disclosure Statement and if any overage they would return it in early December. This year I did not receive any statement even though I do know that there is an overage. I called today and was told the analysis was to be done in January, but that they would run it today and call me back. No call back yet. The credit union is aware of my plans to file though I have not filed yet. I do have a lawyer and once his retainer is paid it will be filed.
