    Bass & Associates reaff nonsense

    Being a former Best Buy credit card holder, I knew I would eventually get the so-called "Bass & Ass" letter asking me to surrender my purchases or reaffirm my debt, but I never thought I'd be this ridiculous.

    They sent me a full reaffirmation agreement, already completed (not sure how they could know that information), claiming that they have a security interest in a variety of items, including stuff that was paid off years ago (I completely paid off the card in April of this year before charging an additional $500 to buy an Apple iPad), including a bag of Reece's Pieces.

    On the cover sheet that was included, they said they were sending it "per my request". Never contacted them concerning a reaffirm and didn't list 'em as a secured creditor (yes, I'm aware that they have a PMSI and they're technically a secured creditor). They did request notice and probably did receive notice that a reaffirmation hearing concerning my car would be held in January, but I certainly never asked them for an agreement!

    Additionally, they included copies of my credit application, highlighting the relevant clause concerning their security interest, and receipts of said purchases. Every time I've read anything about "Bass & Ass," they've just wrote a letter saying they had a security interest and you should surrender purchases, not specifying what those purchases are.

    I'm assuming I should just ignore the fine folks at Bass & Ass, right? I really don't think they'd come after the iPad that I purchased, but in all fairness, they do retain their value...

    i included a best buy card and they never sent any reaffirmation agreements

      Hi mrbrown,

      They are infamous for this type of collection activity which is probably a violation of the automatic stay.

      To get the stuff they have to file for relief from the automatic stay, follow state repossession laws, and then send someone to get your stuff which you can say was lost/stolen/dog peed on it/ etc. Would cost more than a dozen iPads which is why they never try to get stuff, just cash.

      Ignore them and they go away...don't sign anything or give them a dime.

        That was certainly the plan, although I was kind of thinking about voluntarily surrendering the Reece's Pieces they claim a security interest in. Of course, I bought them in December 2009 and they are, well... digested!
