Feels soooooo good to be able to answer the phone without cringing now!

Have been avoiding phone calls for months now. Have been able to answer two this morning, give them the case number, and their tone automatically changes. Loving it!! Not saying I'm happy about our situation, but grateful that we've found a way out of this mess and know that a brighter future is ahead.
04/01/10 - Hit rock bottom and knew we were going to have to file for bankruptcy and surrender our home. 12/14/10 - Filed Chapter 7, 02/09/11 - 341 Hearing, 04/14/11 -

I love how after filing, only a few creditors called a few times and that was it. I remember a couple of them asking if they could work out a repayment plan with me and I started laughing. I only wish I had told them to.... are you ready??? to...

        POUND DIRT!

I only had a handful of creditors, and the only one i got the joy of actually telling to go lick a lightpole in the dead of winter was AMEX, who called the night after I had filed earlier that day (and they had been calling a few times a day for a month). The lady on the phone said she was calling in regards to my Starwood card. I told her I had filed BK. She then asked if I knew which chapter, and I told her 7.

She then asked for my lawyer's name and firm's address, the case number, and the state filed in. She then asked if I was aware that the card would then be canceled and closed. I giggled and said yes (and thought to myself....no she is right to ask...I know people dumb enough to keep using the card after filing it off). She then said I would get a notice of the account closure in the mail sometime soon and she thanked me for my time. She was polite the whole conversation (surprisingly).

Other than that, the phone has been silent since filing day, and yes it's a WONDERFUL feeling! Especially during this time of year, it feels great not having that added stress constantly reminding you that you owe people money you can't pay.

I was getting some creditors such as Discover, hounding me about 6-10 times a day. I would change my ringtone to eliminate most of the ring, but would still get the sound of the call coming in and sometimes voice mails. So I ignored the calls, but the call would still come in and distract you (so the creditors are purposely trying to intimidate you, make you feel extreme stress and do not care in the slightest how much personal stress you are going through). I tried repeatedly for months to work out repayment plans and they didn't want to work with me. Other creditors worked out a plan, but also repeatedly called and harassed me.

So when I finally filed, it felt incredible that I would no longer have to hear these jerks calling me and harassing me. They all could have worked it out with me and I would not have filed bk, but they refused and instead kept tacking on more fees and more charges and harassed me more, so they got this as a result. I will never do business with Discover or with credit cards again. They have lost my business for life and I hope they suffer on the bottom line for the way they have treated people during the recession (this is the only way for them to learn is when they lose profits).

I had a similar experience today.. doorbell rings and it is a creditor serving me paperwork for a potential judgment!!! Now I think it is out of SOL but either way.. no worries. I took it and said "Filed bankruptcy last week!" Can't wait to fax the paper to them!

I, too, am enjoying the phone not ringing. I made little signs for over all the phones in our house with our case # and lawyer info. LOL Hubby cracked up over this.

Synopsis of the 2 calls we recived yesterday:

Capital One - guy was kind of snarky when I said we had filed for bankruptcy protection. Told me that if they did not receive a BK Notice from the courts within 30 days they would place me back into collections. :eyeroll: Okie dokie!

Chase Card Services - they have been the nicest collection calls of all during the time we stopped paying our bills and prior to filing our BK. I was shocked because their mortgage collections department can be kind of rude. The woman that called yesterday said she knew we were having trouble due to illness and job loss and I interrupted her and told her that due to those events we had filed for bankruptcy protection. She said that she was sorry to hear that but hoped that things would be better for us in the new year. Then.... I burst out crying. I couldn't stop myself. So I sniffled and snorted through giving her all the info and she said again that she wished us well.

No calls today and usually Navy Federal (who has the RUDEST collections department in existence - and this with only being 33 days past due over all) usually calls on Sunday.

                        Oh, well, quiet is better.

None of ours have been rude at all -- our credit cards at 8 months at this point with no payment, but even through all of that, they just would always take our info and said they'd check on us again later. Chase, of course, we did receive a summons from the day before Thanksgiving, but luckily, we were ready to file early December so it wasn't an issue. That couldn't have worked out better time-wise.

The only one who's been rude was the jerk (and I'm being extremely kind in that description) that called today from a bank that we don't even have a loan with and spouted off some social security number that's not even close to being mine - but yelled at me literally that I was lying and go ahead and talk to your attorney, blah, blah, blah. I just hung up on him. I thought, 8 months of collection calls, and the ONE rude idiot is a call that isn't even our debt!

You really just have to laugh at this point to keep from crying!

Just noticed your dates in your signature -- I'm so jealous!! We filed Dec 14th, and our 341 isn't until Feb 9th! I was so bummed about that. We're in Florida but not where things have been hit super hard by the recession, so I was really surprised by our timeframe, but guess it just is what it is.
