    Surrendering vehicle?

    Hi guys,

    I don't know if any of you remember me but I'm the girl who had the idiot attorney that lost us a lot of stuff we were supposed to be able to keep through bankruptcy, but I digress. I'm just happy to be free of all the debt.

    Anyway, our bankruptcy was discharged on November 30, and we still have my car that we gave up in the bankruptcy. It's worth about $10k and I owed about $15k on it. I haven't heard anything from the bank and I asked my attorney and he said drive it til they pick it up . . but I'm trying to make alternate plans for a vehicle as I'm pregnant with twins in the middle of winter and soon will be starting multiple doctors appointments a week (OB, perinatologist) and I'm nervous about being left without a vehicle and trying to make all my appointments, go to school, and pick my son up from school. My DH drives a manual transmission subcompact that I can't fit behind the wheel of or drive, lol, and he needs it for work anyway. So I'm TRYING to figure out what to do but I wish I just knew when they'd take MY car rather than waiting around to be car-less.

    For those that have surrendered cars, how long did it take for the financing company to pick it up? Did you have a backup plan for when it was taken? Did the bank contact you and give you any notice at all? And does anyone have experience with surrendering a car to Navy Federal?

    That's a long time for a credit union. They might have forgotten about little old you.

    If you live in a house with garage, and don't have a day job, you can keep it pretty much until you are ready, or the court tells you, to let them pick it up.

      Chowder, I don't have a day job (I'm a student using the Montgomery GI Bill, which basically pays the same as a min wage job around here) but no garage. It's out in the driveway. I'm just nervous about waking up one day and its gone, or being told to surrender it that day and then trying to find another vehicle quickly. We are new to this area and know no one around here and its a rural area so no public transit and I have to have a vehicle. Ugh!

        My dear husband put a black sock on top of the identification number and parked behind mine for a while. I hope that you are able to do something. When they finally took my car (only 31 days) for credit union, I went to a buy here/pay here and got a vehicle,

          I'm the same situtiation as you, doomed. Yes, I remember you. LOL. I got discharged on 11/23 and I'm still driving a surrendered car, which has a a balance of $11,000. I haven't got any calls or letters from the bank. The bank is Santander. My plan is to save as much money as I can for a downpayment on another car. I'm sure I'll get a very high-interest loan somewhere.

            Have a gate to a back yard?
            You being out in the sticks will help. They tend to be a little more leery about walking up to dark houses. People get shot for that kind of stuff.

            The ticket is to make it as difficult to move as possible. I don't know of a state where they are allowed to move another car to get access to the target car. I've seen them do it anyway though.

            But the big problem will be that school parking lot.

              Hi doomed, good to hear from you again, congratulations on the discharge!

              Maine, right? You will get a "cure" letter and have 14 days to respond b4 they can repossess. So they won't come by dark of night and swipe the car, you get at least a 2 week notice.

              Had another thought (record for today) ...contact NFC and see if you can negotiate something w/ them?

              Whatever happens, I hope your new arrivals arrive OK and you can get a multi-kid car by then!!

                      Hey everyone, thanks for the responses. I've been trying to get the bank to pick this car up as we have nowhere to store it for the winter but no one returns my calls or tells me what to do . . . how long can they ignore us before the car is considered abandoned?

                        Disregard my last post, I FINALLY got to speak to my case manager. She wasn't returning my or my lawyers calls, apparently because they have NO security interest in the car. They lost the Title (said we have it??!?!) and converted it to a signature loan right before we filed, which was discharged. I just bought a new car on FRIDAY not knowing this!!!!!!

                          Late to the party here, but my CU took only 3 days from discharge to repo.

                          Can you return the new car? And...did you get a loan just a few weeks after discharge, or buy with cash?

                            I have a loan. But I just talked to my attorney and he said if there is truly no lienholder on it, the car belongs to the trustee, so my excitement is gone, lol.

                              Another Santader loaner here, praying they lose my title too, hahaha. i was with Citi, before they sold it.

                              My discharge is set for Jan 8th.
                              I wont be driving it to work, and hubby is gonna keep it in the garage until we get a letter or something official as I havent heard BOO from them. I was only 2 weeks late when we filed, then I got nothing from them.
                              I am gonna buy a lock for the garage.

                              is colorado like maine, where i will get a CURE letter?
