I have a question about “Payment Advices…”. We filed about a week ago and got a letter from the court that they needed, “Copies of all payment advices or other evidence of payment received within 60 days before the date of filing of the petition, by the debtor(s) from any employer for good cause shown.”
We’re self-employed and do not draw a paycheck (just use what we need to pay the bills) from our business or from anyone else other than what clients pay us for our services. Over the past 60 days, we did receive checks from clients, but obviously not payroll checks. It seems obvious to me that I don’t have an employer in the traditional sense so I wouldn’t need to submit anything other than the form mentioned below, but do I need to submit copies of deposit information (from clients) to the courts or will our bank statements to the trustee be enough (the trustee has also sent us a letter requesting the last 90 days bank statements)? We’ve filed pro se and while all of this seems clear to me, I don’t want to mess it up in case it’s interpreted differently by law and dismissed because of something like that.
The court included a form, “Debtor’s Response to Order regarding necessity of filing payment advices” which basically has us declaring that “…we did not receive any payment advices or other evidence of payment from any employer during the 60 days before the filing of the bankruptcy petition…” so I’m thinking that this is all the court needs and not any copies of client deposits.
If anyone out there can offer reassurance that I’m on the right track (or not), please advise.
Other than that missing item that the court sent us, it appears that all other paperwork is in order. We are set for our 341 on 1/11/11 so praying that it’s a lucky date for us. This has been such a stressful time, but glad that we finally got the ball rolling and seeking relief and a new beginning (fingers crossed). Never want to go through this mental drain again!
