Continuance of 341 Meeting

I just check pacers and this it said there is a Continuance of 341 Meeting? Any Idea what this. I know that I didn't request it nor did my attorney. We attended the original 341 Meeting on 11/22/2010. So I don't know what this is. It also says its for Monday Dec 6th 2010 at 8:59am.

Are we in trouble?

I am like really freaking out. I know that the Trustee wanted to keep the case open until he could see the 2010 Tax Refund. Is that What this could be. PLEASE HELP! We are extremely nervous and due to the weekend we cant get a hold of our attorney. ARE WE IN TROUBLE?

Hi calco86,

This is not the trustee keeping the case open to administer assets. A continuance means something wasn't finished at the first 341 so the trustee wants to meet again. But the trustee almost certainly would have said something at the first 341....was there a document missing, some numbers your atty was going to recalculate, didn't have a soc. sec. card, something....??

Hope it is something simple...

He had everything but the 2010 tax return. We didn't get notice about the meeting in the mail, i just log in to PACERS and found it. He posted it on 12/3/2010 for Monday 12/6/2010 @ 8:59AM, We wouldn't even have a notice if I didn't check PACERS..

What do we do? The first 341 Meeting says terminated and then the Continuance of 341 came up? Any Idea?

If you don't get a hold of your attorney before Monday morning, I suggest you show up at the 341 meeting. Better safe than sorry.

Okay, But its not like we got a notice in the mail...

Hi calco,

A missing tax return would easily explain the continueance....tax returns are required to be available to creditors before the 341. I would definitely attend, in theory it is a required attendance.

It is a govt process, you just didn't throw enough paper at it. Lets hope this is just a minor procedural bump in the road!
