    Deficiency on Repo – Which Schedule?

    In an instance where a vehicle was repossessed by the lender and sold resulting in a deficiency amount, where should the deficiency be listed?

    Schedule F – Creditors holding unsecured non-priority claims
    Or
    Schedule D – Creditors holding secured claims

    Creditor has already taken and disposed of collateral. Once taken, creditor becomes an unsecured creditor therefore is listed on Schedule F for "balance due on contract after repossession". Further, if repo was within the past 12 months, the repo info is put in the Statement of Financial Affairs, question 5.
