Debtor Field: Both Debtor (Husband) and Joint Debtor (Wife)?

    Debtor Field: Both Debtor (Husband) and Joint Debtor (Wife)?

    I am going to file myself, but I can't figure out whether the Field "Debtor" on some of the documents refers to me, the Husband and person filling out the forms, or if it refers to both me and my wife. Some forms have fields for both of us, some forms have fields for just one of us.

    Do I fill in both of our names in Debtor field if only one is provided? Or do they want just my name and my wife will be included according to the case number? OR...do I fill out two sets of forms for the ones that only have one debtor field?

    Clearthebook, you may want to post this in the "pro se" forum....for those that file their petitions themselves...most likely you will get someone experienced to lend you a hand...



    i'm certain you will find some of the site's "best" pro se filers there to help!

      By filing yourself, do you mean Pro-Se, or do you mean you are filing but your wife is not?

        good question...however, i just figured since op referred to the "field" in which to answer they were filling out the paperwork themselves??

          Hi Clearthebook,

          If you are filing jointly, both you and wife, put names separately where there are two spaces, and put both names in the entry with one space.

          If you are filing without an attorney (pro-se) do you have the NOLO book? www.nolo.com It is a step-by-step guide to filing a BK.

          Also, if you are filing pro-se, go to your courts website and find the Local BK rules; this will have things like the order of documents, format of the creditors matrix, cover sheets or variations of forms, staples or paperclips, that sort of thing.

          Have fun with the paperwork, I think we killed 3 trees filling ours out...

            i think we did that as well and didn't even file pro se....i can't believe how much paper this bk brings to the surface! i'm not awaiting the two year mark for some reason...so i can burn it all!
