    Newbie with Bank Account Question

    Hi! I've been lurking here for several weeks, but this is my first post. Thanks to all of you I have learned so much about the bankruptcy process. My husband and I are planning on filing chapter 7 sometime next month.

    My question is about a bank account. We live out in "the sticks", my husband has an hour drive to work. It would be out of his way to drive to our local bank where our checking account is, so several years ago he opened an account between here and work. Every week he has $150 directly deposited into this account for his expenses. He uses it mainly for gas, cigarettes, beer, the occasional McDonalds, and sometimes gives me cash for gas and groceries. The problem is he always goes by the ATM and withdraws money, never uses the card as a debit card, and never keeps receipts. I am so scared that a trustee will think he is taking the money out and hiding it under the mattress or something...which is definitely not the case, but with no receipts...and even if he kept the receipts the trustee might consider some of these expenses unnecessary (beer and cigs). But my hubby finds them a necessity.

    Do you think this will be a problem with our chapter 7? We are a family of 3, living in the state of Missouri, and under-median (by less than $2,000).

    You are going to need 6 months or so of bank statements when you file, and the trustee can find out everything they need to know from there. Should not be a problem...

        Every week he has $150 directly deposited into this account ...if this was $1500 you might have a problem, but $150 is peanuts in a BK. Just put the words 'husband' 'hour drive' 'cigarettes' and 'McDonalds' together in a sentence (leave out beer since he is driving).....no one will even blink.

          Thanks Tom! I'm so glad it appears this isn't going to be an issue. I am so paranoid that they are going to try to push us into a 13, not sure why, we don't make that much and have nothing of value...just my nerves!!! lol

            Hope you got enough turkey to calm those nerves!

            ...and besides turkey, there is a book that will help; the NOLO book (www.nolo.com) ...nice step-by-step guide to filing a BK, you can look over the whole process.

            And of course, all the folks here are glad to help!
