    Tell me what you think of this...I'm going to wait 60 days before filing

    After reading these posts and worrying, I've decided to delay my filing for 60 days to give my credit cards a chance to cool off. My attorney wasn't really worried about it, but since I decided to file so quickly I hadn't stopped charging up until 30 days ago. He said that he hasn't seen the CC companies file any APs for regular charges within the 90 days, but I am too worried and would rather wait. I have also been wanting to trade my car in before my credit dives south, but he had advised me to wait. What would you say to trading my car in and filing in 60 days? Too soon? I would want to keep the car. Thanks for your opinions!

    if you can jacey...i would put as much time distance between you and your filing time....i know your atty is most likely correct...but i would wait min. the 90 days and not even consider it prior to that time passing....one never knows what a creditor will do..

    sometimes if, in that district the credit..i.e....chase has a "few" people that are filing they may chose to file or attend...just because that day may be worth the creditor while...so better to be safe than not.

    we waited two years!!!! but moved out of town so really no one could find us, which was nice...i guess we went "underground"...wow...LOL!!!

    but bottom line...wait out the 90 days!

      Hi Jacey,

      Remember that it will take $$$$ for a creditor to file an AP and object to a debt. Under $500 and no 'luxury' purchases it isn't worth their time to go after it.

      The situation on the car depends on several factors....lots of folks change up cars right before a BK, usually getting rid of overpriced gas guzzlers for a low mileage, high mpg, nice used car. Don't end up with equity over your states exemption amount, don't end up with an upside down loan, and don't end up with a large payment.

      Now if you want to take tobee's path, sell the car and buy a ticket to a nearby country, ... Hi tobee!
