    What is the court date for? Are you named in the suit? If so, than you want to attend the court date. If you are not able to pay a lawyer right now maybe you can ask for a continuance to have time to find and retain an attorney. (?)

    I have no idea about IL insurance laws. In my state, you must maintain insurance on any car that is titled. You also must carry uninsured motorist coverage. Not having insurance will get your license suspended and cause a whole lot of grief. Since you own the car, most likely they can go after you...if you broke any laws, than its possible the judgment might not be dischargable in BK. On the flip side, if you say your father didn't have permission to drive the car, than he could be in serious trouble. Again, at a minimum I think I would consult with an attorney before you do anything.

    I'm in agreement with everyone else - your father doesn't need to file bk right now. As for you, I would probably let the whole accident case play out before I did anything there, but again, you need to consult with an attorney.
