    Yet another question

    I'm so sorry everyone, bit of info. 341 was oct 28. and we paid off my car last week and now we are just in the wait and see. I got sick a week in half ago and I got a dr. bill, we don't have ins nor jobs . Can I cash out a 401k ? or do I have to wait till the discharge?

    If you filed with a lawyer, I would ask her/him. Personally, I wouldn't do it.

    Until your bankruptcy case is officially closed, all of your assets (exempt and non-exempt) are property of the bankruptcy estate. Also, the trustee still has time to object to your exemptions.

    Someone else on this forum was recently told by their lawyer they would be fine to borrow from a 401k because it would be considered a post-filing debt (& that would be fine) in their district.

    I wonder if your doctor would let you work out a payment plan with them.

      I'm with Debee. Call the Doctors office and agree to pay them X amount per month so it doesn't go to collections.
