    341 Meeting and Credit Report Questions

    Hey Guys,

    First off I want to thank you for all the information so far. I have a couple questions thou?

    (1) On my credit report some of the creditors stating that I have declare Bankruptcy but hasn't drop the amount due, will this happen when we get the discharge or should they be doing it now? I get alerts when things change on my credit report.

    (2) Our 341 meeting is on the 22nd of Nov and wondering what paperwork should be bring? Also I see from another topic that we should bring a updated bank statement. Is this correct?

    (3) A week ago I bought a pistol so I can get my Armed Guard Cert in New York and hope to make more money by doing so in the security or investigator side which I have a interview on the 17 Nov. Will this effect anything? The pistol was pretty cheap. (400) I used my debit card to buy it so it will be on my bank statement but I want to get your opinion on what I should do.

    (4) Does the trustee only look at stuff before the filing or after too.

    I just don't want to get into any trouble..

    Did you file through an attorney? If so, the attorney should be able to tell you what you need to take with you to the 341. If you filed pro se, the trustee will usually send you a letter stating what you will need to bring with you. If you receive nothing from them, I would take at the very least: your bank statement that includes the date of filing, the last couple years of tax returns, receipt for the gun with an explanation ready if he asks any questions about it.

    The reporting on your credit should go to $0 and IIB after the discharge, I believe.

      Hi calco,

      Don't bet on the credit bureaus getting the reporting correct, before or after discharge. If they don't have it right by the time the case closes, request the notation be changed.

      As to documents, federal rules say 2 yrs of tax returns need to get to the trustee before the 341 (not sure how far ahead, 10 days comes to mind) and you have to have drivers license/passport/govt ID and soc. sec. card at the 341.

      Anything else will be particular to your trustee, get your atty to ask or you ask the trustee what they want to see and when.

      The job interview is a good thing, go for it. You might get asked about employment status at the 341, just be honest. Same w/ the bank statement, if the trustee asks about it, just be honest. Under the new BK law, the trustee can ask about finances before and after the filing, but they are going to be looking for big discrepancies from your schedules, luxury purchases, large $$ transfers, fraud, etc.

      Your $400 pistol required for employment is not going to be a problem unless you take it to the 341 and point it at someone....
