One last question hopefully. Does the homestead exemption even apply to her since the home is not her primary residency? It is also my understanding that in Missouri the 15k exemption is not multiplied for each co-owner.

Thanks everyone for the information you have been able to provide me. Believe me I will gladly pay an attorney when needed. I actually checked with my general practice attorney who has done some bankruptcies. He wasnt sure of everything regarding my situation because it is a bit less common. He suggested we wait to see if she files and then find out who the trustee is and try to work a buyout deal with him. I then talked to someone in Missouri at the Bankruptcy Protection Center PC and the guy there is telling me the bankruptcy will have no effect on the house since I am living in the house and paying the mortgage. He said the trustee wont be able to do anything besides wait for the house to sell and then go after her half of the equity. Thats not what my ex-wife was telling me her attorney told her but she has been know to fabricate the truth. Im going to get atleast one more opinion from a bankruptcy lawyer on this before I feel at ease.
