they could have, we notified the bank we were leaving....actually our bank waited until we were out...about a week, and then they secured the house....changed all the locks...pad locked all the gates...
the bank has a sign up about when the property was winterized etc. the bank in our case mows the lawn, keeps fuel in the oil tank as well. $$$$ for the foreclosure fees and costs!!

And, yes, you probably could have stayed in the house until now. But, you would now be arranging to move during the holidays.
yes, i think that is exactly what happened....the auto stay was lifted and the banks going forward. hopefully at more than just snails pace for the OP so there may be some closure.

Yes I did file my bk right after my first notice.. We moved out ASAP for peace of mind.. also not really knowing how long we would have before the final notice.. First time in a Bk, had no clue what so ever, except for coming here and asking a ton of questions, and thank God for that, I would have lost my mind during the whole process had I not found this place

me too!! i'm not sorry we left...and it was after 33 years we had to leave our house. i know we could have stayed longer...but we knew we had to get out...winter was setting in and the heat and electric bill ran $1100 a month ...a lone!

i just wish they would foreclose on our house already! it's been 2.7 years....and we aren't even close...now chase has that paper problem and i'm certain our loan was involved soooooooooo...it's probably that and the fact...BLACK MOLD...Flooding..cracked foundation and so on and so forth...the bank most likely can't even sell it and it will be knocked down!

Wow 33 years, that's a long time.. We had only been in ours for 11 years, still I'm glad we left when we did.. I found a great house, within my price range and in the same school district so my daughter could still attend the same school. But on the flip side, had i stayed and saved some more money, I could have at lest got out of Florida, so tired of this state !!

If your house was part of an HOA, you could actually still be responsible for those since the date of filing. Even though the bank has the house.

good point...sure thing about the HOA....you can file the BACK dues and have them discharged but not the one's while you awaiting foreclosure. we were lucky and didn't have them....but so many places in florida surely do!

My BK is in the process of discharging ( any day now ) and I included the house in the BK, and am not going to reaffirm.. I refuse to move out of the house until it is actually sold as I will make back the 20k I put down by not paying rent by moving... I am in NM and I hope it takes a long time, buy my lawyer said its taking about a year currently. I am going to have to be strong, and its going to be hard living here knowing I am loosing here but I need to continue to save money!

WF didn't do anything to you other than notify you of your impending foreclosure -- which they are legally obligated to do. Take a few minutes to learn about foreclosure laws in your state so you won't have any more surprises.

Let me make sure I'm understanding this correctly. I did have HOA, which i did add into my BK, So now your saying that I could still owe them from the date that I filed or the date as to which i was dischaged from my bk ?? In other words I still owe my Hoa dues for the past year ?
