our 341 was today, worried....

Our 341 was this morning. We waited in courtroom and watched most of the other people go before us. The Trustee asked several questions of them. He requested amendments on a few filers, and scolded a few.

It was our turn, we went up and raised our right hand, showed our SS card, & Drivers Lic. sat down, stated our name & address. He asked if everything was true in our filing, and asked if we expected to receive any money from relatives in next 6 months, then he said thank you, and we were done. We were sitting up there 1 minute ! Ours was the shortest we had seen.

Should I be concerned? I don't know what to make of it. We were over the median income a little, and slightly over on the means test. We only briefly got to speak with our Attorney in the hallway before leaving, as he had to get to another courtroom. He said everything went great, nothing to worry about.

Listen to your attorney! Sounds like it went great and you should not be worried. Deep breath !

Ours was 75 seconds...and we're grossly over median...you'll be fine, really!

I guess I am worried because when I called attorney's office last week to double check with one of his office workers, that I had everything I needed in order for our 341, I asked the gal over phone how she felt our case would fare with the trustee. She said that she felt pretty sure we would be forced to convert to a CH 13 due to our income, but that we may be able to get by with a Ch 7 , depending on how trustee decides. She told me we should get a feel which way he was leaning towards at our 341. Well, I didn't get a feel either way, so guess I will just have to wait & hope, sigh.......

As others have said, seems you have nothing at all to worry about. I do have a question - do you remember what some of the people got scolded for that were up before you?

not washing their hands after using the restroom....?? we saw no one scolded..but i'm certain it happens all the time!

ferfermom, you are fine, don't worry at all. I found documents on PACER the day after my 341 but some people have reported that it takes longer.

pikaroth, in my 341, people ahead of me got scolded mostly for not filing their taxes or filing them incorrectly. For example, one woman had filed as Head of Household when she was married and the husband lived with her. Another couple had a business but hadn't included it in their taxes. There were numerous people who had BMWs, Mercedes, boats, and timeshares -- there were some questions about those but no scolding.

Congratulations on your easy 341. You will be fine. As far as a posting on Pacer, it all depends on the TT and how backed up they are. Some people see a report within a day, a few days. Ours was posted within a week. It just depends. If there was anything glaring at the TT, he would have asked you then. And usually, the UST would have been in touch with your attorney if they were trying to push you into a Chapter 13. Relax, you should be fine.

My attorney told us to expect a 7-10 business day delay between our 341 and the update in PACER - he said our Trustee filed updates every week or so and might be a week behind.

Three days later we received the Notice of No Distribution on PACER. So, the answer is...it will take exactly ????? days.

Yes it all depends on the Trustee or court.. Here in NM I had mine on Pacer within hours of my 341! That is rare though I have been told

The next thing to find on PACER is the trustees report of no distribution...

PACER finally had this posted today, REPORT OF NO DISTRIBUTION, AWAITING DISCHARGE . That is what I want to see correct? I cant believe it ! I was so sure we were going to have to convert to a 13. I hate to say it seemed too easy. We have for sure learned our lesson about over extending use of credit cards ! $80,000 in debt was killing us. I will only use cash or debit from now on , thank you God , thank you fellow forum friends...........now we await discharge , which should be Dec 26th, a very Merry Christmas indeed............
