I have an hourly job that pays weekly every Friday. In order for me to get a paycheck though, I have to submit a timesheet on time. If I accidentally or purposefully submit a paycheck too late, I would get two paychecks the next week both with the same pay check date of that next week.
I plan to file Chapter 7 in December. I believe means that my six month income is calculated only from what was earned from June through November and based solely on check dates, not when the work was performed.
I am very close (razor thin margin) to the median income and my paychecks can fluctuate up and down a few hundred dollars each week.
If I find myself in a position where my last paycheck in November will put me over the median across six months, can I postpone that last November paycheck a week so that it shows up in December and is not counted towards the June to November income? I'm sure a trustee would catch on to the manuever, however would this stop me from filing in December and force me to wait until January, or would it just simply tick off the trustee or judge? Does anyone KNOW the ramifications/consequences?
