    Checked Pacer, Discharged on 10/25/10!

    We were discharged today according to Pacer. We are an asset case, so I don't expect our case to close anytime soon. I'm just a little on edge because our vehicle didn't get reaffirmed (didnt receive any paperwork from bank to reaffirm and don't want to get a repoed). Now that we are discharged, our relief of stay has been lifted, don't know what can happen with cell phone service, cable, ect.. Since our case isn't closed, can the trustee come after our tax refund in Mar? Hopefully nothing happens and I can get on with my life!

    I'd say since you are an asset case, they can come after the pro-rated portion of your tax return due at the time of filing. (Divide the refund by 365 and multiply by the number of days up to the date of filing). The panel trustee can intercept the refund from the IRS and then send you whatever portion he determines doesn't belong to the estate.

      little on edge because our vehicle didn't get reaffirmed Have a copy of 11 U.S.C. ยง541(c) handy and stay current

      don't know what can happen with cell phone service, cable, ect.. hopefully nothing, but if you included them in the BK they might ask for a deposit to continue service

      can the trustee come after our tax refund in Mar? can, but that doesn't mean they will. If its not a huge amount and the trustee didn't mention it, you might just skate by...

      BUT....you have a DISCHARGE!! Whooo Hooo!!!
