    Should I call the trustee?

    I filed Ch 7 pro se on 9/30 and have yet to get a letter in the mail in regards to what documents the trustee would like and when he would like them. My 341 is 11/12 so I still have some time. Does the trustee normally take this long to let us know what his requirements are or am I supposed to call him to find out? Not looking to make the trustee mad by not following protocol.

    Not at all will you make him angry. You will be talking to his assistant I am sure. Usually in our state FL there is a conference pre call of the 341 in the lawyers office. Either the Trustee or his assistant will go over things that are asked at the 341 and what to bring. Get the C7 book from Nolo for 26 bucks download. It will list what is required, but you should and it is not improper to call him direct. You are your own lawyer so that is allowed. 'Hub

      On my attorney's website it has a list of do's and don'ts. And calling your trustee was a don't. Reason being was the trustee is not your friend and you should have no contact with them unless they request it from you.



      Sorry just saw you are pro se. So yes I would call and find out what to bring. Sorry

          Thanks for the quick responses. I will call the trustee's office and find out what I need to bring. I like the idea of talking to an assistant anyway. Thanks again.

            I also filed pro se in Michigan. I did send my tax return to the trustee at least 7 days before my 341, but my trustee didn't ask for anything else. He never requested a thing. I think if your filing is thorough and your case simple, you may not have to provide anything besides the tax return.
            A fresh start is a beautiful thing. And I'm not an attorney, just opinionated!

              So I called the trustee's office yesterday and talked to the nastiest, meanest assistant ever. I gave her my case number and the fact that I filed pro se and just wanted to know what the trustee required me to bring to the 341. She cut me off and said read the back of the letter from the court. Everything you need to bring is on the back of the letter. And before I knew it there was dead silence because she hung up. After reading through quite a lot of material on the back of the court letter, I finally came across what to bring: ss card and driver's license. That's it! I thought income tax returns were always a requirement. I think I will bring them anyway just in case. I don't want any problems.

                Bring the tax returns just in case. I was never asked to submit mine, but because of reading here I knew he would probably need them. Sure enough he asked for them at the 341, I was able to pull them out of the folder and the meeting continued without missing a beat.

                  Thanks sunkship. Did you bring just last year's tax returns or the last two years. I've heard either or so not sure which one's to bring.

                    Bring your bank statement showing your bank balance on the day of filing too, if you haven't already provided it to the trustee.

                      Thanks Laurie. No, I have not provided bank statements to the trustee because as you read his assistant was not very cooperative. Seems like she's setting you up to fail. Well, anyways, thanks for the great info. I really appreciate it.

                        I got a list of things to give to my lawyer. She said our trustee was very through. Would you like for me to copy and paste the list I was given?
                        I'm pretty sure you need two years tax returns, past 90 days bank statements, SS card and drivers license, pays stubs for 6 months just in case.
                        Why go in unprepared? I'd bring more than enough, not the minimum.

                          We were sent a letter asking for the bank statements of the month that included the filing date and one month after, the last three years tax returns, an itemized list of how we spent our last tax refund, and possibly receipts (ouch!), and our dl and ss cards; if divorced in the last 5 years, a copy of the divorce decree and any settlement agreements, copies of vehicle titles, a letter from your employer if you are exempting tools of the trade, NET wage computation of wages due you at the time of filing, etc. etc.
                          Filed pro se, made it through the 341, discharged, Closed!!!

                            I have no clue as to how I spent my last refund. I was working at the time in another state and didn't know at the time that I would be contemplating BK in the future. There's no way I can remember nor could I come up with an itemized list and no receipts, for sure.

                              mommi2many- I brought 2 years, he only wanted to see one. I would rather have too much than not enough. I agree that bank statement from filing date is also a good idea, but I was not asked for it.

                              Some people even bring marriage certificate- some districts require it, others do not. I showed mine- because I could not find my social security card with my married name, but had the maiden name card. That with the marriage cert was proof enough for trustee.
