immediate ch 7 file?

    immediate ch 7 file?

    alright so i been working on the chapter 7 forms for a while now still do not feel comfortable filing all the paper work... but i really need to file this week to get the auto stay... now if i file the bare min. here in NJ "installment app, and rest" what do i do after that? just mail the rest of the petition when i am complete? and does it cost extra to do this?

    also what order do i submit this immediate petition in?

    This guide should answer many of your questions. From what I read, you have to file all the forms, but if you don't get them all in at time of filing, you have 14 days to file the remaining forms.

      ya thanks i am almost ready but i am going to file the immediate file section just so i can get the stay in place i will be able to get the rest of the stuff in before 14 days.... what order do i have to send the stuff in? do i need some type of cover letter?

        Found this in the site I posted for you, but thought I'd save you time and post the section here that refers to immediate filing. Hope this helps!

        "What if I must file immediately, but can’t complete all required forms?

        If you have to file a case immediately, you MUST file Official Form 1 Voluntary Petition, Official Form 21 Statement of Social Security Number(s) , a credit counseling certificate from an approved credit counseling agency (or indicate on Exhibit D a Request for Exemption or Exigent Circumstances) and a creditor matrix. You must have at least one creditor on your creditor matrix. In addition, one of the following must accompany the petition at the time of filing: the full filing fee of $299 OR Form 3A - Application to Pay Filing Fee in Installments OR Form B3B - Application for Waiver of the Chapter 7 Filing Fee."

        As far as the order it needs to be in, our clerk here told me that they reorganize all the paperwork according to their specs, but I'd call the court clerk in your district to find out if they have any specific requirements for the order the papers are presented in.

          i think im going to drive to the court with the papers, do they need to be in any sort or order or with a cover?

            Again, the court clerk can tell you if they need to be in any certain order. I don't think any of the courts require a cover letter. The petition to file is usually the first form on the top of the stack. If you are going to take them in, I'd put them in order that they are listed in the blurb above. Otherwise, if you just want to be certain, call the court clerk and just tell them you are ready to file, and just want to know if they want your paperwork in any certain order. They're usually very nice about giving you that information.

              Hi greg,

              You really need to be on the website free2breathe gave you. Everything you are asking about is there. Find the local bankruptcy rules, this is where the document order, what cover sheets are required, how to format things, how to caption pages, whether you can use staples or not, all the nuts and bolts. If you haven't read your local bankruptcy rules before filing, you are fixin' to shoot yourself in the foot.....
