    Discovery of assests

Does anyone know how the trustee's go about discovering assets?

    #2
I imagine the Trustee can learn just about anything they want to learn about any BK filer. And remember, the Trustee has a Judge at their disposal to authorize any type of search the Trustee deems necessary.

Your Soc Sec number. They can access your Credit Report. There's your entire financial history at their disposal. Every bank you've ever had an account with. Every loan you've ever taken. Every CC you've ever had. Unless it's so old it dropped off due to age.

They can contact the appropriate offices to check on your Deed, your vehicle titles, any type of property transfers that are registered with the State. They can track your driver's license and check on tickets, wrecks, DUI's, etc.

Large transfers of cash that are handled by a Bank are always recorded and reported. It's required. Significant deposits held by banks or financial institutions on your behalf are already recorded. Especially if the bank or financial institution is FDIC insured. There's a financial records data base.

The Trustee can order an inspection and appraisal of your household if they choose too.

There's not much about any of us that a Trustee couldn't learn if they really wanted to. Especially if they smell money. If a Trustee thinks there's money to be had, they will leave no stone unturned.

I am not an attorney. My comments are based on personal experience and research. Always consult an attorney in your area to address concerns related to your particular situation.

They usually don't go through all this since it's time and money unless someone gives them a reason to. Never, never give them a reason to do this.

Thanks for the info SF. I'm not trying to hide anything I was just wondering if I could look at some of the same information they use to find assets. Hell if they find anything it will be news to me.

Does anyone know how to find out whose name is on a vehicle title?

You should have a copy of your vehicle title which will have the names on it. If you don't have a copy, you can get one at the DMV.
