    State Tax Garnishment?

    Filed pro-se emergency petition last week. Full filing not in yet.

    The State is taking $250 a month garnishment from my wages for back taxes. I am ok with this, but wondered if I HAVE to notify the state to STOP the garnishment. Right now I really could use the money to save up for a car, then dont mind continuuing paying them after the Chapter 7.

    Do I get the BK notice to the state now myself, and not wait for them to receive the BK filing notice (I put them on the matrix)? Work said they needed a release from the state to stop the garnishment.

    At this time I have to go back and check the years I owe the taxes for, so some may be dischargeable. I hope

      I don't file pre se so I don't know much about it. Hopefully someone with better knowledge will help you then, but to be safe and speed it up, you can call the state, advice them of your filing and give 'em your case number. It'll be stopped while your bk is open but once you get discharged, the garnishment will continue. My student loan payment will resume pretty soon.
