does anyone know the reaffirmation laws in florida?
if i don't reaffirm my auto loan with my local CU will they let me pay and ride?
thanks
It isn't so much the law. If your CU does not wish to let you ride through, they do not have to. If your Trustee and/or the Judge believes you cannot afford to ride through, it will not be allowed. You cannot force a ride through. I would advise a ride through over a reaffirmation in any case though.
I reaffirmed my CU car as I only had a few payment left on it. Hope this helps.
You know, I'm not sure there is ANY law about ride throughs. 'Hub
If I knew it all, would I be here??Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.
The new BK code requires a reaffirmation (or redeem or surrender) in one place, then lets you rescind it w/in 60 days.
It lets secured creditors pursue the return of their collateral in one place, then in another it says a BK by itself is not a breach of contract.
With the mess the law is in, you need to find out what your lender is going to do. Credit Unions do not have a good rep. for acting uniformly, seems each one is different. So the best course of action is probably to ask them directly and work off their answer.
Good luck with it,
