    will this be an issue in my ch. 7 bankruptcy?

    Hi again. I just filed bankruptcy and am extremely worried about my 341 meeting...one thing I thought of that might catch some attention is the fact that 6 months ago I purchased a 2008 Civic and I placed a large down payment on a credit card (it was about 1,900 or so)....will this purchase be cause for concern? I have made payments since then and am current on the account as of today.

    One other transaction I'm concerned with is that I took a 3500.00 balance transfer check from capital one (it said to use the checks for anything..) to pay for bills for about a month and a half when I was on unpaid FMLA time back in July helping my mom recover from a series of surgeries. I cashed this check in mid to late June 2010. The money is all gone. I have also kept current on this account.

    Other than that the last transaction I made on a credit card was in august I bought a plane ticket for 300 dollars but I made a payment of that amount on the card that month, so i essentially didn't increase the balance at all...

    Last question I have (for now, at least..lol) does anyone know if Fifth Third Bank in Ohio will repo a car that is not reaffirmed in bankruptcy? I would rather not reaffirm it just in case I lose my job or something. I owe exactly what the vehicle is worth according to kelly blue book trade in value. Are most banks OK with ride-throughs? I am current on payments.

    Sorry for the lengthy post...I'm just very nervous and worried about the entire process and can't wait for it to be over with. I really appreciate all the advice and can't thank you guys enough for all the great info i've obtained on here.

      Sorry for the blank post, my computer is a having an issue w/ the touch mouse pad.....

      Are you filing pro-se or through an attorney? I think your credit use is going to raise a lot of questions...

      To cure the nerves on the 341 meeting, go attend a few meetings. Should give you a good idea of what questions the trustee will ask, what they focus on.

      To hang on to the car, stay current and keep up the insurance. The odds they will repo are low, but go ahead and ask them. See if they have a BK dept and ask someone there.

      I think you really should get some legal opinion on the credit charges....

        mgs...if you can attempt to put as much time between you and your filing date. in other words WAIT....hire an atty....begin making monthly payments but do not file until you put more time between those charges and your filing date.

        the law clearly defines 90 day period of charging, however, i agree with tom, these type of charges may just raise some eyebrows, and you certainly do not need that.

        i would see if the atty can get the 341 moved back a few months...they can do it once or twice. however, your atty should have advised you at the time so attempt to put more time before they filed for you. see if you can put it on hold for a few months.

          The capital one blank check from June is probably going to be an issue if you don't put six more months or so between it and filing. Capital One is notorious about filing ap's on things like this. For the car advance, if you can also put some more months between you and filing that would be great, but six months should be enough for that one.

          If you can keep paying minimums and wait another 90 days minimum, it will help your chances of avoiding an ap.
